1. Order Acceptance and Confirmation

Your placement of an order on mareksupplements.com constitutes an offer to purchase from Marek Health LLC. Marek Health LLC reserves the right to accept or refuse any order at our sole discretion. Order confirmation via email does not guarantee acceptance of your order or availability of the product.

Marek Health LLC may, without liability, limit the order quantity per person, household, or geographic area, or cancel any order at any time prior to shipment, including orders that appear to be placed by the same customer under different accounts or that we believe are for purposes other than personal use.

2. Pricing and Payment Terms

All prices displayed on mareksupplements.com are subject to change without notice. Marek Health LLC reserves the right to correct any pricing errors, whether in product listings, shopping carts, or order confirmations. In the event of a pricing error, we will notify you and offer you the choice to either proceed with the corrected price or cancel the order.

Payment Disputes and Chargebacks:

You agree to contact Marek Health LLC prior to initiating any chargeback or payment dispute with your financial institution. To the extent permitted by law, you agree to reimburse Marek Health LLC for any fees, costs, or expenses incurred in responding to improper chargebacks.

However, Marek Health LLC does not warrant that product descriptions, pricing, or other content on our website are error-free or complete.

Product images are for illustrative purposes only. Actual product appearance, including color, shape, and packaging, may vary slightly from images shown online due to variations in photography, lighting, and manufacturing processes. These variations do not constitute defects.

4. Purchase For Personal Use Only / Anti-Resale Policy

This is a non-negotiable term of purchase.

You are the intended end consumer and final user of these products
You agree NOT to resell, redistribute, or transfer any purchased products for any purpose, whether for profit or otherwise
Resale of Marek Supplements products on any platform—including but not limited to Amazon, eBay, Facebook Marketplace, Poshmark, other e-commerce sites, or any other resale channel—is strictly prohibited
You agree not to use these products for commercial purposes, wholesale distribution, or any business activity

Enforcement and Consequences:

Marek Health LLC reserves the right to refuse service, cancel orders, suspend or terminate accounts, deny future purchases, refuse refunds where permitted by law, and pursue all available legal remedies against any customer reasonably suspected of purchasing products for resale or otherwise violating this Anti-Resale Policy. This includes suspected resale activity involving multiple accounts, aliases, addresses, payment methods, third parties, or other methods intended to evade purchase limits or resale restrictions. Marek Health LLC may also report suspected resellers to third-party platforms, payment processors, shipping providers, and law enforcement as appropriate.

This policy protects the integrity of our brand, supports fair pricing for customers, and prevents unauthorized distribution channels.

5. Order Quantity Limits

Marek Health LLC reserves the right to limit the quantity of any product that may be purchased in a single transaction or across multiple transactions by a single customer within a specified time period. These limits are enforced to prevent bulk purchasing for resale and to ensure product availability for all customers.

If we reasonably believe that an order or series of orders violates our quantity limits or is intended for purposes other than personal consumption, we may refuse the order or cancel it without liability.

6. Risk of Loss and Title Transfer

Risk of loss and title for all products transfer to you upon delivery of the products to the carrier (USPS). Once your order is handed off to USPS, Marek Health LLC is no longer responsible for loss, damage, or delay in transit. You are responsible for any loss or damage that occurs after the products are transferred to the carrier.

7. Sales Tax

Applicable state and local sales taxes are required by law in certain jurisdictions. Marek Health LLC will calculate and collect all required sales taxes based on your shipping address at the time of purchase. These taxes will be itemized in your order and invoice.

8. Order Cancellation

Customer Cancellation:

You may request to cancel your order only if the request is submitted before the order has been processed for shipment. Once an order has been picked, packed, or handed off to USPS, cancellation requests cannot be fulfilled. Requests for cancellation should be directed to info@mareksupplements.com with your order number.

Cancellations approved prior to shipment will receive a refund to the original payment method within 5–10 business days. Shipping costs, where applicable, are non-refundable unless the cancellation results from Marek Health LLC error.

Company Cancellation:

Marek Health LLC reserves the right to cancel any order at any time before shipment without liability. Reasons for cancellation may include but are not limited to:

Suspected resale or bulk purchasing
Out-of-stock inventory
Suspected fraudulent activity
Violation of these Terms of Sale or our shipping policies
Geographic or order quantity violations

In the event of a company-initiated cancellation, you will be notified via email and refunded in full to your original payment method within 5–10 business days.

9. Shipping Terms

Marek Health LLC ships products via USPS (United States Postal Service) to addresses within the United States only, including all 50 states, U.S. territories, APO/FPO addresses, and military bases. We do not ship internationally at this time. Orders shipped to military addresses or territories may require additional delivery time.

Free Shipping:

Orders totaling $99 or more (before taxes) qualify for free USPS shipping to continental U.S. addresses.

Paid Shipping:

Orders under $99 are subject to shipping charges calculated at checkout based on weight, destination, and selected service level.

Once your order is handed to USPS, Marek Health LLC’s responsibility for delivery ends. USPS delivery times are estimates only, and Marek Health LLC is not responsible for delays caused by the carrier, weather, holidays, or other circumstances beyond our control.

10. Returns and Refunds

Marek Health LLC maintains a 30-day return window from the date of delivery. Returns are permitted only for unopened, unused products in their original, resalable condition.

Return eligibility requirements:

Product must be unopened and unused
Product must be in original packaging and pristine condition
Return request must be submitted within 30 days of delivery date
Product must not have expired or become damaged due to improper handling by the customer

Non-returnable items:

Opened or used products
Products outside the 30-day return window
Damaged products due to customer mishandling
Expired products
Custom or special order items (if applicable)

Refund method:

Approved returns will be refunded to your original payment method within 5–10 business days of receipt and inspection by Marek Health LLC. Return shipping costs are the customer’s responsibility unless the return results from Marek Health LLC error or defective product.

Marek Health LLC reserves the right to limit or refuse returns from customers exhibiting excessive or abusive return patterns.

11. Product Availability

All products are offered subject to availability. Marek Health LLC does not guarantee that any product will remain in stock. In the event that a product becomes unavailable after you place an order but before shipment, Marek Health LLC will notify you and offer alternative options or a full refund.

Marek Health LLC reserves the right to limit the quantities of any product available for purchase per customer, per household, or per geographic area at our sole discretion.

12. Subscribe & Save Program

Marek Supplements offers a Subscribe & Save subscription program powered by Loop, available on select products through mareksupplements.com. Subscription terms, including pricing, billing frequency, and cancellation method, are presented clearly and conspicuously at checkout. By enrolling in Subscribe & Save, you agree to the following terms:

Enrollment and Pricing

Subscribers receive a 10% discount on the regular retail price of subscribed products for each recurring shipment.
Subscription pricing is subject to change. If we increase the price of a subscribed product, we will notify you by email at least 14 days before your next billing date. Your continued subscription after the price change takes effect constitutes acceptance of the new price.
Promotional pricing or introductory offers may apply to the first shipment only, unless otherwise stated.

Billing and Renewal

Automatic Renewal: Subscriptions are billed automatically every 90 days (approximately every 3 months) to the payment method on file. By enrolling in Subscribe & Save, you provide your express informed consent and authorization for Marek Health LLC to charge your payment method on a recurring basis at each 90-day interval.
Billing Date: Your billing cycle begins on the date of your initial subscription order. Subsequent charges occur every 90 days from that date.
Failed Payments: If a scheduled payment fails, we will attempt to process the charge again. If payment cannot be collected after reasonable attempts, your subscription may be paused or canceled.

Managing Your Subscription

You may manage your subscription at any time through your account on mareksupplements.com or by contacting customer service at info@mareksupplements.com or (877) 572-2582. Available actions include:

Cancel: You may cancel your subscription at any time through your account portal or by contacting customer service. Cancellation requests must be completed at least 48 hours before your next scheduled billing date to prevent the next charge. Cancellations take effect at the end of the current billing cycle — you will not be charged again, but no partial refunds will be issued for the current cycle.
Modify: You may change the product, quantity, or shipping address for your subscription at any time before the next billing date.
Skip: You may skip one or more upcoming shipments without canceling your subscription. Skip requests must be submitted at least 48 hours before your next scheduled billing date.

Subscription Shipments and Returns

Each subscription shipment is subject to the same Return & Refund Policy as one-time purchases (30-day return window, unopened products only).
The Anti-Resale and Authorized Distribution Policy (Section 4) applies to all subscription orders. Subscription enrollment does not authorize resale of products under any circumstances.

Compliance with Auto-Renewal Laws

This subscription program is offered in compliance with the Restore Online Shoppers’ Confidence Act (ROSCA) and applicable state auto-renewal laws. By subscribing, you acknowledge and agree that:

You are enrolling in an automatic renewal subscription plan.
Your payment method will be charged automatically every 90 days until you cancel.
You have the right to cancel at any time as described above.
You will receive a confirmation email upon enrollment that includes the subscription terms, pricing, billing frequency, and cancellation instructions.
You will receive a reminder email before each renewal charge.

13. Disclaimer of Warranties

PRODUCTS ARE SOLD “AS IS”

Marek Health LLC sells all products on an “as is” basis. Except as expressly required by law, Marek Health LLC makes no warranties, express or implied, regarding the products, including but not limited to:

Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
Warranties that products will meet your expectations or requirements
Warranties regarding product quality, safety, or effectiveness
Warranties that products are free from defects

You assume all risks associated with the use of products purchased from Marek Supplements. Marek Health LLC is not responsible for any loss, injury, or damage resulting from the use of our products.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

In no event shall Marek Health LLC, its owners, employees, agents, or representatives be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunity
Personal injury or property damage
Defective products or manufacturing defects
Any damages arising out of or related to your purchase or use of products

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if Marek Health LLC has been advised of the possibility of such damages.

Your sole remedy for any defective or non-conforming product is a refund or replacement, as determined by Marek Health LLC in its sole discretion, subject to the terms of our Return & Refund Policy.

The total liability of Marek Health LLC in any circumstance shall not exceed the greater of: (A) the total amount you paid to Marek Health LLC in the twelve (12) months preceding the claim, or (B) fifty dollars ($50.00). This liability cap is consistent with the Limitation of Liability set forth in our Terms & Conditions.

16. Additional Terms

Compliance with Law: Your use of mareksupplements.com and purchase of products must comply with all applicable federal, state, and local laws. Marek Health LLC reserves the right to refuse service to any customer if we reasonably believe their purchase violates applicable law.

Incorporation of Terms & Conditions: These Terms of Sale are subject to and incorporate by reference the Terms & Conditions available on mareksupplements.com, which constitute the master agreement governing your use of the Website and Services — including the arbitration clause, governing law, class action waiver, and anti-resale provisions. In the event of a conflict between these Terms of Sale and the Terms & Conditions, the Terms & Conditions shall control.

Entire Agreement: These Terms of Sale, together with our Terms & Conditions, Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Marek Health LLC regarding your purchase of products and supersede all prior negotiations, understandings, and agreements.

Severability: If any provision of these Terms of Sale is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
